1. Acceptance of Terms

By downloading, installing, or using ServiceProof ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

ServiceProof is a mobile application that enables service professionals to document jobs through photos, digital signatures, and professional reports. The App offers both free and paid subscription tiers with different feature sets.

3. Account Registration

To use ServiceProof, you must:

  • Be at least 18 years old (no exceptions)
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access

You are responsible for all activities under your account. We reserve the right to terminate accounts that violate these Terms.

4. Subscription Plans and Billing

Available Plans:

Free Tier

  • Up to 20 lifetime jobs
  • 25 photos per job
  • Basic PDF reports
  • Automatic cloud sync and backup
  • ServiceProof branding on PDFs

Pro Tier - $19.99/month

  • Unlimited jobs and photos
  • Priority cloud sync
  • Professional PDFs without ServiceProof branding
  • Custom company branding
  • Client portal for remote signatures
  • Priority support

Billing Terms:

  • Subscriptions auto-renew monthly unless cancelled
  • Cancel anytime through your app store account
  • Price changes will be notified 30 days in advance
  • No refunds for partial months
  • Failed payments may result in service suspension after 3 attempts

5. User Content and Licenses

You retain ownership of all content you create with ServiceProof. By using our service, you grant us a limited license to store, process, and display your content as necessary to provide the service.

You agree not to upload content that:

  • Infringes on intellectual property rights
  • Contains illegal or harmful material
  • Violates privacy rights of others
  • Contains malware or harmful code

6. Remote Signing and Client Portal

The remote signing feature allows clients to sign documents electronically. By using this feature:

  • You acknowledge that signing links expire after 48 hours
  • You are responsible for verifying client identity
  • Electronic signatures may not be legally binding in all jurisdictions
  • Client data shared via portal is subject to our Privacy Policy
  • SMS/email fees may apply based on your carrier

7. Third-Party Services

ServiceProof integrates with the following third-party services:

  • RevenueCat - Subscription management and payment processing
  • Supabase - Cloud storage and authentication
  • SendGrid - Email delivery for remote signing
  • Google Sign-In - Authentication services
  • Apple Sign-In - Authentication services
  • Expo - App infrastructure and analytics

Use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party service outages or changes.

8. Intellectual Property

ServiceProof and its original content, features, and functionality are owned by ServiceProof and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Include:

  • Description of the copyrighted work
  • Location of infringing material
  • Your contact information
  • Statement of good faith belief
  • Statement of accuracy under penalty of perjury
  • Electronic or physical signature

9. Privacy and Data Use

Your use of ServiceProof is also governed by our Privacy Policy, which is incorporated by reference. By using the App, you consent to our collection and use of data as described in the Privacy Policy.

10. Disclaimers and Limitations

SERVICEPROOF IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not guarantee:

  • Uninterrupted or error-free service
  • Accuracy or reliability of content
  • Legal validity of electronic signatures in all jurisdictions
  • Protection against all security threats

OUR LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

11. Indemnification

You agree to indemnify and hold harmless ServiceProof, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

12. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute arising from these Terms or your use of ServiceProof shall be resolved through binding arbitration conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

  • Arbitration will be conducted in English
  • Location: Your county of residence or our headquarters
  • Each party bears their own costs
  • Small claims court remains available for qualifying disputes
  • Class action lawsuits and jury trials are waived

13. Force Majeure

We are not liable for failures or delays due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

14. Changes to Terms

We may update these Terms at any time. Material changes will be notified via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance of new Terms.

15. Termination

We may terminate or suspend your account at any time for violation of these Terms. Upon termination, your right to use ServiceProof ceases immediately. You may delete your account at any time through the app settings.

16. General Provisions

Governing Law: These Terms are governed by the laws of Arizona, without regard to conflict of law principles.

Entire Agreement: These Terms constitute the entire agreement between you and ServiceProof regarding the use of the App.

Severability: If any provision is found unenforceable, the remaining provisions will continue in full force.

No Waiver: Our failure to enforce any right or provision is not a waiver of that right or provision.
